hmm.. this sounds like something judge judy would have to handle. but no, seriously, you might have to go to a small claims court b/c if you are sending the checks to her and she just isnt cashing them, thats her fault. you ARE paying her. and there is a record of the checks you write obviously, so its kinda of weird she wont accept the money. did the other people offer more? for the sake of keeping the puppy and if its not a problem for you, maybe you can offer an extra $100 or so. i hope this helps.

first off if she is a breeder, report this incident to the AKC give her name address breed of dogs she breeds, send them a copy of the papers she gave you on the vaccinations of the dog. She is supposed to make sure any puppy she sells has their first shots. AKC will be interested to know also if this is a breeder of pure breeds. If she is and is selling dogs of mixed breeds and still claims her dog that had that puppy is a pure breeder, she could lose her AKC accreditation.
Then contact her BBB (Better Business Bureau)file a report on her there.
She has turne the puppy over to you, hopefully you have it micro-chipped.
I bought a puppy in June and have bonded with him and wouldn't part with him for anything.
Hope this helps. Keep us informed.

You have a contract. She has to honor the contract. She cannot repossess the puppy without you breaching the contract.
I would send her a letter and a check for the full payment. In the letter, point out that you have followed the contract, she must also follow the contract. Tell her that if she does not, then she will be liable for all attorney fees and expenses in obtaining the forms.
If she does not respond or cash the check, get an attorney to draft a letter to that point, and send it registered mail with a bill for the cost of attorney services so far.
You will probably not recoup the attorney fees, but she will likely send the papers at that point.
Good luck.
Oh, and I have read a few of sunny's answers. He is either clueless or does not read the question. In this case, it is obvious that he did not read the question as he thought you did not have a contract.
And DO NOT offer her extra money. You hold all the cards here. You are better off pointing out that not upholding her end of the contract will cost HER money.
HOLY CRAP! You are getting bad advice. DO NOT SEND MONEY ORDERS! You have a reciept, but she can claim that she never got them. SEND CHECKS! You can show if she ever cashes them, and trace them back to her. Money orders are SO MUCH HARDER TO TRACE!
Okay, I am convinced that people do not even read the details. IT IS CLEARLY STATED THAT THERE IS A WRITTEN CONTRACT PEOPLE!
ROZ...GREAT ANSWER. It is great to follow up and try to be sure this pathetic excuse for a breeder cannot do this again.

Here is my advice:
1. Make sure you keep every receipt for the certified mail.
2. Continue to mail checks by certified mail. make copies of the checks before you send them.
3. keep all your records for food expense, accessories, vet, etc. for the puppy. Include gas expense, phone calls.
4. Never talk to her again without a witness or a recording of the conversation. Maintain your decorum no matter what she says to you or threatens.
5. Never miss a payment or even be late.
6. Have the puppy microchipped at the vet.
You must keep all your receipts in an orderly fashion and document every transaction and communique you have with her. You are building a case and a very good one should she attempt to sue you.
I am so sorry this happened to you. A puppy is such an added joy to a family.

Wasn't a good idea to get the puppy maybe?
What is actually wrong with your dogs health? It would have been a good idea to check out the health of the parents and asked the breeder lots of questions. By asking questions you can monitor how good of a breeder she is and how sincere she is in relation to her concerns for the welfare of the animals.
Change your phone number and take the puppy to the vet.
When I bought my puppy he had diarrhoea for almost a week with the transition of food but you say your pup had the runs the day you got it. Did the breeder look upset to see the pup go?
As for the ear infection, my puppy also had one about one week after I bought him but I think his was due to accidently getting wet when I washed him. My dog has the long floppy ears so once a week I use treatment called epiotic which helps with waxy ears and keeps them clean which save $$ and visits to the vet!

To the best of my knowledge of the law, she has no right to take the dog back. She would have a case if you hadn't paid her anything upfront, and if you hadn't been making attempts to pay her the remaining amount.
Here's what you need to do, if you're not already.
Keep good track of when you speak with her (or, when you attempt to speak with her)-- written down, day, time, etc. Keep record of the check numbers and the exact amounts (the record of them being un-cashed will keep itself in your bank statement.) Also, make sure to keep the money in the bank, incase she's just collecting the checks with the intent of cashing them all at once.
If you do not have any record of your prior conversations with her regarding the payments and the cashing of the checks, contact her again and write the details down.
If she were to take you to small claims court, and you follow the steps in recording every step of this, you'll be all set. You paid some money upfront, and you can show (I'm assuming) that you made every effort to pay her the rest of the money.
From what you've said here, it doesn't sound like she has any chance of forcing you to give the dog back.

The contract says she has to recieve them. If you have proof that you gave her payments...she should have nothing to hold against you.
What you need is proof that she has recieved the payments.
I would go with JWs advice...send her a letter via registered mail...telling her you honored the contract but she did not....if you want to be super-safe you can cancel your check she did not cash send her another one with a letter via registered mail...so you'll have proof that she recieved the payment and make it clear that you honored your part of the contract
Be sure to hold on to your records of the checks you wrote so you can show that you did write checks to her.
I personally think she doesn't really want the puppy back but was so offended at your mention that the puppy was ill that she's turning some screws on you...but still keep it safe

>>>>>>>>>>>>
I'm thinking about selling my home Lease to Own. I'm worried about insurance liability and tax consequences as well as my current mortgage company calling my loan "due on sale" because I'm no longer the owner occupant.
<<<<<<<<<<<<<<<<<
In your lease, you specify that the "renter" pays you the amount of the fire insurance premium AND property taxes which you continue to pay. The lender CAN NOT call the loan for the due on sale UNTIL you actually give a deed to the property to someone.
<<<<<<<<<<<<<<<<<<
Can I keep this home as my perminent address when I move out of state? I'll pay state tax in MI but TX has none. My wife co/owner would change her address to the new Texas location.
<<<<<<<<<<<<<<
MI can not be your permant home if you move out of state but your lender does not care where you live as long as you make the home payments and you have not given a deed to the home to someone else.
>>>>>>>>>>>>>>>>>>>>>>>>
What about a living trust? Would this protect me from liability? Will my current mortage company allow me to re-title the property to a living trust?
<<<<<<<<<<<<<<<<<<<<,
You can retitle you home to a living trust and your lender can NOT call your loan for doing so.
You should notify you lender that you are doing this and put the fire insurance in the name of the living trust. You and I assusme your wife will be the beneficiaries of the living trust.
A living trust is a private document. Now if you have a smart buyer and they have a good attorney (that you pay for), the beneficiary of the living trust can be changed to your buyer and your lender will not know about it.
You should tell your lender you did this but you are under no legal obligagtion to do so.
GOOD LUCK
