Real Estate Question/ Legal Question?
I bought my house in Texas through Wells Fargo 10 months ago. The house was bought with no disclosures. My realtor said that the reason for no disclosures was because the couple who was selling the house had not been in the house long enough to know if there are any problems with it, I took her word for it. I had the inspector look at the house, he said it looked fine. When we moved in, the neighbors kept coming over and telling us that the house and the entire yard floods every spring. Well the yard is flooded now because of a pond that doesn’t have a drainage system in our backyard. That is something else we found out. Come to find out, the septic system was broken when we moved in. I had a septic installer come out the other day and he told me that because of the flooded yard, he legally cannot install a septic system on our property. I contacted a lawyer and he said it would cost more money than I have to try to sue the sellers and they might not pay if I won the case anyway. Should I walk away, try to get a short sale, or try to get a deed-in-lieu of a mortgage? HELP!!!!
Would You Take Legal Action Against A Family Member?
My Father passed away several years ago, leaving property in another state (texas). This property belonged to his parents and was granted to all of the heirs, (my sister and I) after my Fathers death we became part of the property owners.
In 2004 my uncle, (1) of my Fathers remaining syblings, decided that he wanted to sale the property. Without our knowledge the property was sold, withing a years time, the new property owners had not received the title to the home, once the research was completed it was discovered that it was necessary to obtain my signature as well as my sisters. At this time my uncle contacted us, not explaining the situation, but forwarding the documents asking us to sign. I ignored his letters, wanting a face to face call. I never heard from him. I received a call today indicaing that he forged our signatures. Should I take legal action, or let it ride? (I have not heard from my uncle since 2004)
